Video Documentation while Riding a Motorcycle

My name is Griff Tonkin. I’m one of the partners here at the Arthofer & Tonkin Law Offices. For me and my family, we ride dirt bikes.

We’re fortunate to live on rural property where we can ride on our own land, which means we’re on public roadways very infrequently. But if you’re a motorcyclist who does ride on the roads, I want to strongly encourage you to wear a GoPro or similar video recording system whenever you ride.

Motorcyclists are often judged unfairly

Too many motorcyclists have made a bad name for the rest of us by riding recklessly. Because of that, I’ve seen — time and time again — that when there are two versions of how an incident happened, the motorcyclist is often believed less.

If it’s your word against a driver’s word, the assumption frequently works against you simply because you were on a motorcycle.

That’s where video comes in. A camera can eliminate the entire “he said, she said” problem by clearly showing what actually happened.

Video evidence can quickly resolve liability disputes

In a personal injury case, we don’t need to prove fault beyond a reasonable doubt. The legal standard is much lower than that.

Clear video footage can often establish fault immediately — showing that an accident was not your fault and allowing us to focus on your injuries and recovery instead of arguing over liability.

This kind of evidence is especially valuable when it comes to preserving proof after an accident, which is something we regularly stress to our clients.

Why liability is so often argued in motorcycle cases

I’ve handled more motorcycle accident cases than I can count where I wished we had high-quality video footage of exactly how the collision happened.

In motorcycle cases, liability is frequently disputed simply because the injured person was riding a motorcycle. Even when the rider did nothing wrong, fault is often questioned.

Understanding how comparative fault works under California law is important — and strong video evidence can significantly reduce the chances that blame is unfairly shifted onto you.

Video can also protect you from insurance tactics

Insurance companies look for any opportunity to minimize payouts. Without clear evidence, they may argue partial fault or make early, low settlement offers.

Video footage can help counter low-ball insurance tactics and strengthen your position from the very beginning of a claim.

It can also be especially important if the other driver has limited coverage, making protections like uninsured or underinsured motorist coverage even more critical.

Make recording part of your riding routine

Wearing a camera only helps if it’s working. Make sure recording becomes part of your regular riding checklist:

  • Confirm the camera is charged
  • Make sure it’s recording before you start riding
  • Download footage when needed
  • Clear storage space regularly
  • Check mounts and angles periodically

It’s a simple habit that can make a major difference if something goes wrong.

Ride safe — and call us if you need help

I don’t believe you’re more likely to be at fault just because you ride a motorcycle. I don’t think you’re a criminal. I want the opportunity to represent you if you’ve been injured by someone else’s negligence.

If you’ve been hurt in a motorcycle accident or any other personal injury matter, we offer free consultations. We’ll listen to your story, explain your options, and help you decide what to do next.
