Going the Distance

I'm Griff Tonkin. I'm one of the partners here at the Arthofer and Tonkin law offices. We're exclusively a personal injury law firm.

That means that we only represent people who've been hurt by the negligence of someone else. Today I'd like to talk to you about an egregious denial of liability by an insurance company. We recently started handling a new case in our office and there happens to be video footage available.

There was an adjacent supermarket to the roadway where the accident occurred and we were able to collect the security video footage which captured the roadway where the accident occurred. What that footage shows is a driver pulling out of the supermarket onto the roadway. Then that driver is struck at a very high rate of speed by an SUV.

The SUV collides with the first vehicle that pulled out of the parking lot and drives it completely off the road and then the SUV continues at such a high rate of speed that it smashes into the car that was stopped for the traffic light just ahead of the van that had pulled out from the grocery store parking lot. So what the video shows is that traffic is moving along very very slowly a few miles an hour at most walking pace and then it shows the SUV entering the frame at a very high rate of speed. At the time the SUV is entering the frame the van is already pulling out from the grocery store parking lot.

Now it's our contention that the van driver made an error but also that the SUV driver made an error. Had the van driver not pulled out at all the SUV driver still would have collided with our client's vehicle. There's no question given the speed the time and the distance.

Well the driver of the SUV is insured by a national insurance company that every one of you would recognize the name of. They have great ads, very funny. That insurance company initially denied liability and blamed the accident entirely on the conduct of the van driver.

However we sent that insurance company the video footage and explained the speed that the SUV was traveling and we were confident based on the video footage that that insurance company would change its liability analysis. Well surprisingly despite literally high definition video of their driver's conduct that insurance company has denied liability. So we're going to take them to task.
